Tyree:

Look at the case of Jose Padilla who, despite being a US citizen, was denied his rights of habeas corpus and was imprisoned for over three years based on George Bush's declaration that he was an "enemy combatant."

That charge was dropped and his case was moved to a civilian court after pressure from civil liberties groups.

Bear in mind that the suspension of habeas corpus was unilateral; unlike President Lincoln's suspension of it during the Civil War, Congress did not acquiesce nor were they even consulted.

That is a very dangerous precedent that some future president will refer back to when we can least afford it. The people of that era will look back at us and wonder why we didn't do something to stop it.

Speaking of politicians who stroke hatred and violence ... I am waiting for some lefty politician to blame conservative talk radio. Given the Democrats' promise to launch a sweeping crackdown on civil liberties if elected I would not be surprised to see the Obama administration try to turn this into an American version of the Reichstag fire. There are racists to be found under every bed (so they believe) and they must be rooted out at all costs!

There would have been two parties to this incident, had it occurred: the perps and the victims. To insert a third party -- the prison system -- is odd, to say the least.

I think you could just as easily insert another third party: the culture of violence, including politicians who stoke fear, uncertainty and doubt about their political opponents. Have we already forgotten the story of Rabin's assassination?
